It will examine preventive documents such as powers of attorney and trusts and their use, along with determinations of incapacity and the attorney’s duties regarding the same, an overview of elder abuse laws and elder resources, the conservatorship/guardianship process for those needing court oversight of the care of their person and/or estate, and will end with an overview of Medicaid eligibility and planning. Now we can have an honest conversation about the costs and benefits of adding more uninsured Floridians to the state’s Medicaid rolls under a provision of the federal health reform law known as Obamacare. For after hyper-inflating the true cost, and getting pushback from legislative budget analysts, Gov. Rick Scott’s administration finally released a more realistic cost estimate for helping poor people get health care. And it’s a shocker. The new pricetag is about a fifth of what the governor has been leading us to believe.
Congress rang in the New Year by enacting legislation to save us all from the “fiscal cliff” the country was precariously dangling from – the “American Taxpayer Relief Act of 2012”. The most important impact the legislation has on estate and gift taxes is that it makes the system that was in place over the past couple of years permanent. As far as estate and gift tax changes go, there weren’t many made in the new legislation.
